One way in which a patent can be infringed is by deliberate copying, or by developing something that is an extremely close approximation of the patented product. If the latter, it could be that the copying company has been advised that the original patent is not sufficiently strong to mount a strong defence in court, in other words that it was not well drafted.

If the situation is one where several features of the product have been copied, then there is a strong argument for infringement, and so the matter may well be settled over a discussion about whether the patent claims themselves are valid. Alternatively, there may be an attempt cover up the evidence of infringement, despite there being a close copy; this can often happen where some material concerning the patent is disclosed in the course of business negotiations. In particular, if a patented product or process has obvious commercial benefits, then it will be in the commercial interest of less than scrupulous business people to work around the patent and develop something similar that achieves the same end. This area in particular gives rise to the most litigation, as expert IP Lawyers argue about whether there is an infringement or not.

Finally, there is a situation that sometimes arises, of accidental infringement. The old adage of “there’s no such thing as an original idea” may come into play here, as many people with a newly patented product will naturally start looking out in their market sector, to see whether there is any rival product that could be claimed to be infringing on their patented product, service or method. If the method that has been patented provides a solution to a common problem – and tapping a lucrative market sector – then it is all the more likely that more than one company is working on the same problem at the same time; and their results could have used the same chemistry of physics. And while the solution may look very similar, it is always possible that it was reached by a very different route.

Explosives pass security checks in Slovakia, arrive in Ireland in failed test

A failed test of security at Slovakia’s Poprad airport resulted in a 49 year-old man unknowingly carrying plastic explosives from Slovakia to Dublin, Ireland. The explosives were concealed so well that the man did not find them when he unpacked his bag at his apartment.

On Saturday, Slovak authorities planted contraband in passengers’ luggage at Poprad’s Poprad-Tatry Airport without the knowledge of passengers. Seven of the eight items were recovered, while an eighth made its way to an apartment in Dublin. Slovak authorities realised on Tuesday that one package of explosives were missing and notified Irish authorities who searched the man’s apartment.

During the search, parts of Dublin’s inner-suburbs were sealed off and evacuated causing disruption to residents and businesses. At the apartment authorities found the package and arrested the man under anti-terrorism laws; he was later released without charge after it was established he was innocent.

The man, a Slovakian electrician had been living in Ireland for some time. He was holidaying in Slovakia over Christmas.

Ireland’s Department of Justice, Equality and Law Reform issued a statement saying, “Following contact earlier today from the Slovakian authorities with the Airport Police at Dublin Airport, members of the Garda Síochána have recovered a small quantity of explosive material from the luggage of a passenger who had flown into Dublin from that country on Saturday last.”

The package contained 90 grams (3 ounces) of the plastic explosive RDX, also known as cyclonite or hexogen. According to Commandant Gavin Young, a spokesperson for the Irish Defense Forces, “On their own, this type of explosive does need to be combined with other elements to make it into a bomb, but obviously this type of high-grade explosive is potentially extremely dangerous.”

Slovakia’s Minister for the Interior Robert Kalinak has apologized to Irish Justice Minister Dermot Ahern over the incident and expressed his “profound regret”. Irish authorities are now investigating the incident and the government has ordered for a full report to be delivered.

The Irish Opposition has expressed concern about the incident. Labour Party spokesman Joe Costello said “This incident led to the closure of roads in the area, the evacuation of businesses and the lives and safety of residents could have been put at risk. We also need to know what protest the government is going to make about this breach of our security.”

Steel major Arcelor ready to reconsider Mittal’s offer

Luxembourg’s largest steel company Arcelor is ready to study Mittal Steel‘s improved takeover offer, the former said on Sunday, opening the door to possible talks with Indian steel magnate Laxminivas Mittal. Arcelor Chairman Joseph Kinsch told reporters after a meeting of Arcelor’s board that the company’s directors would be ready to examine the details of Mittal’s latest offer once it has been approved by the CSSF (Luxembourg’s financial regulatory body).

Until Sunday, Arcelor, the world’s second-largest steel company, had firmly rejected world-leader Mittal’s bid to take the former company over and form a global steel giant. The softening of Arcelor’s stance comes after Mittal Steel raised its hostile cash-and-equity bid by a third on Friday and dropped a key demand for family control over the combined entity.

Media reports had suggested that Arcelor was trying to find another company to rescue it from being taken over by Mittal Steel. Possible candidates included Russian tycoon Vladimir Lisin and Russia’s Magnitogorsk Iron & Steel Works (MMK). Mittal’s move on Friday came after the value of its initial offer fell more than 10 percent behind the market worth of Arcelor, as the latter announced a buyback of its own shares at above-market prices to ward off Mittal Steel.

Laxminivas Mittal, who has hinted that the bitter takeover battle might have a hint of racism involved in it, told the French newspaper La Tribune that he was sure that the attractive nature of his revised offer would enable him to obtain over 50% of the Arcelor shares. He added that he was of the opinion that the involvement of a Russian third party would not be in the best interests of Arcelor’s shareholders.

Bomb blasts near Greek Minister’s house

A bomb exploded near the house of the Greek Culture Minister,Georgios Voulgarakis, in Lycabettus Hill, Athens, wrecking a number of cars.

The device, which the police said consisted of 2-3 kg (4-7lb) of dynamite, had been placed on a bike left between two cars.

The explosion at 7:42am (GMT +2), close to the home of Minister Voulgarakis, is the second time the former Minister for Public Order has been the target of a bomb attack.

While the perpertrators are not yet known, Giorgos Voulgarakis, who had been receiving death threats, is unpopular with leftist parties over questions of immigration.

A trained dog of a Greek anti-terrorist unit had been sniffing around the area of the Minister’s home each morning. The September 2003 attack nearly burned down his house.

Two primary schools and a kindergarten nearby were slightly damaged but there were no reported injuries.

As bomb technicians searched the school grounds, frantic parents rushed to take their children home.

The leftist “Epanastatikos Laekos Agonas”(Revolutionary popular rally), is the group which some Greek media have accused for today’s bomb attack. No official claim of responsibility has yet been made and the police investigation continues.

All the Greek parties, including the major opposition party, PASOK; the Communist Party (KKE), Synaspismos and LAOS parties, have strongly condemned the terrorist attack.

Bratsk hydroelectric plant gets new turbine

The city of Bratsk in Irkutsk Oblast, Russia, received a new turbine for its famous 4,500 megawatt hydroelectric plant founded in the mid-1950s on the Angara river. In future this new unit will cause an efficiency rise up to 255MW for each turbine.

Currently, the Bratsk Power Station operates 18 hydro-turbines, each with capacity of 250MW, produced by the Leningrad Metal Works (“LMZ”) in the 1960s. The plant is the second level of the Angara Hydroelectric Stations cascade. Since its full commissioning in 1967, the station was the world’s single biggest power producer until Canada’s Churchill Falls in 1971. Annually the station produces 22.6 billion kWh.

The precious 80 tonne cargo was transported to Pulkovo International airport of Saint-Petersburg where it was loaded on Antonov An-124-100 Ruslan to made all the way to Bratsk by air. On October 4, 2006 it landed in the Bratsk airport. In two days the unit 16 replacement arrived to the assemble place on the Angara river.

Sergey Emdin, CEO of IrkutskEnergo JSC, noted the press that the Bratsk plant reconstruction project includes not only the economical, but the ecological aspect by reducing carbon dioxide emission for 6 million tonnes for the period of 2008-2012.

In 2006 and 2007 the old plant is scheduled to receive two more working wheels – by one for each year respectively, and in 2008 and 2009 another four – by two for each year.

China and Russia continue joint army exercise

Russian and Chinese armed forces began their first ever joint military exercises since the Korean War, when Russia was still part of the Soviet Union, on Thursday. The exercises are expected to last for eight days.

10,000 troops — about 1800 Russians, the rest Chinese — are participating in the war games. The exercises simulate United Nations-mandated police action to restore order in a fictitious country torn by ethnic unrest. They began in the eastern Russian port-city of Vladivostok and are supposed to culminate in a mock invasion involving beach landings and paratrooper drops off the coast of the Jiaodong peninsula in eastern China.

Russian and Chinese officials have framed the exercises as promoting international cooperation, but some in the US and elsewhere see the exercises as preparation for a possible future invasion of Taiwan, and as a challenge to US dominance in Asia — particularly in Afghanistan. The exercises come amid increasing speculation in the US that China may come to replace the US as the world’s greatest superpower.

Russia and China are working together to help form of a world order that will be based on multipolarity, respect for international law, and a leading role for the UN, Deputy Foreign Minister Alexander Alexeyev said on Monday, August 15, 2005.[1]

“The exercise will be carried out in the framework of the fight against international terrorism and extremism, to respond to new threats and challenges,” said Liang Guanglie, chief of staff of China’s armed forces.[2]

But others citing the use in the operation of advanced aircraft atypical of a peacekeeping operation, say the countries have ulterior motives. “The main target is the US. Both sides want to improve their position for bargaining in terms of security, politics and economics,” said Jin Canrong, professor of international relations at the People’s University of China.[3]

A Taiwanese official quoted by Mosnews.com said, China’s involvement in the operations represents “the biggest security threat in the Asiatic-Pacific region.” [4]

However other analysts speculate that Russia’s motivations for using the aircraft, including Tu-95 strategic bombers and Tu-22M long-range bombers, in the exercises may be to promote their sale to the Chinese.

“Military cooperation is linked with political and economic cooperation as part of a bigger package,” said Robert Karniol, Asia-Pacific editor for Jane’s Defence Weekly. “It’s not an adversarial posture.”[5]

Many have noted that the joint exercises are an emblem of increasingly warm relations between China and Russia since the dissolution of the Soviet Union. But writing In an editorial for the International Herald Tribune, Phillip Bowring disagrees, saying that the primary purpose of the operations is as a warning to the US. “The current Russia-China joint military exercises are not so much a symbol of trust and friendship between the two as a symptom of American overstretch. The two are reminding the United States of the limits of its unilateral global power.”[6]

Despite speculation into the motives of Russia and China, the US has given at least token support to the idea that the exercises could promote international interests. “We are following the exercises,” U.S. State Department spokesman Sean McCormack said this week. “We expect that they will be conducted in a manner that supports some mutual goal of regional stability shared by the United States, China and Russia.”[7]

Others say the operations are mainly a response to separatism and Islamic extremism in Russian Chechnya and the Chinese Xinjiang.

“The exercises are the logical continuation of the first signs of cooperation between Russia and China in the struggle against ‘orange revolutions,’ separatism and the dominant influence of the U.S. in the Euroasiatic sphere,” the Gazeta.ru news website wrote Thursday. Orange was the color adopted by supporters of last year’s revolution in Ukraine, which along with mass demonstrations in Georgia and Kyrgyzstan, brough pro-Western administrations to power. [8]

The war games have been called “Peace Mission 2005“.
